| | 2. | WASTE INDUSTRIES SELLS FINAL FLORIDA ASSET |
| | | Waste Industries USA, Inc. (Nasdaq: WWIN) has announced the sale of its Old Kings Road landfill in Jacksonville, Fla. to Advanced Disposal, also of Jacksonville. The landfill is a standalone C&D facility that is not supported by a company hauling operation. The sale of this operation means the company no longer has operations in Florida. |

| | 3. | PENNSYLVANIA LANDFILL WINS STATE SUPPORT FOR WTE PLAN |
| | | The Conestoga Landfill in New Morgan, Pa. has won approval for its gas-to-energy project from the state Department of Environmental Protection over objections from Berks County. County commissioners contend there are design problems with the project. Granger Energy is supplying a gas-fired generator that would provide a small amount of power for sale on the local energy grid. Pennsylvania has 22 gas-to-energy projects that generate 60 megawatts of energy. |

| | 4. | NEW ORLEANS CITY COUNCIL, MAYOR AT ODDS OVER NEW LANDFILL |
| | | The New Orleans City Council is calling on Mayor Ray Nagin to consider Katrina disposal alternatives beyond a proposed construction landfill on the edge of the Bayou Sauvage National Wildlife Refuge. Nagin has said the new landfill is necessary for the city to continue cleanup of hurricane debris. Waste Management of Louisiana has pledged to give the city 22 percent of the gross revenue the landfill draws. |

| | 5. | EPA FINDS TWO HAWAII LANDFILLS IN VIOLATION |
| | | The federal EPA has determined that the Waimanalo Gulch landfill in Kapolei, Hawaii and the West Hawaii landfill in Waikoloa do not meet federal clean air requirements. Gas collection and control systems at the Waimanalo landfill apparently exceeded temperature limits, and the Waikoloa facility failed several reporting requirements. The EPA found Honolulu, the County of Hawaii, and Waste Management of Hawaii Inc. face fines of up to $32,500 per day per violation. |

| | 6. | MAINE DETERMINES STATE HAS SUFFICIENT LANDFILL CAPACITY |
| | | The Maine Department of Environmental Protection has concluded that the state has sufficient capacity to dispose of all the waste generated within the state. The state would have denied Casella Waste Systems' application to increase capacity at the Pine Tree Landfill in Hampden had the company not withdrawn it. Casella had offered to limit the amount of out-of-state waste disposed of at Pine Tree if the DEP would license future capacity. But company officials said that the climate was not right for the application and so withdrawn it.
